Supreme Court Bar Bodies Demand Independent Inquiry Into Alleged Police Action Against Student Protesters

The Supreme Court Bar Association (SCBA) and the Supreme Court Advocates-on-Record Association (SCAORA) have expressed concern over the alleged use of force by the Delhi Police against student protesters during a recent demonstration in the national capital. Both legal bodies have called for an independent and impartial inquiry into the incident, while urging authorities to ensure accountability if any excessive use of force is established through due process.

The statements were issued after protests linked to concerns over alleged irregularities in public examinations, including the NEET-UG controversy, witnessed clashes between demonstrators and police during a march towards Parliament amid the ongoing Monsoon Session. Reports from the protest site indicated that police used lathi charges and tear gas to disperse the crowd after the gathering attempted to move towards restricted areas.

The incident has since sparked widespread debate among legal professionals, political leaders, student organisations and civil society groups regarding the balance between maintaining public order and safeguarding citizens' constitutional rights to peaceful protest.

SCBA Condemns Alleged Excessive Use of Force

In a formal resolution, the Supreme Court Bar Association strongly criticised what it described as the alleged use of disproportionate force against peaceful demonstrators.

According to the Association, several students reportedly sustained injuries during the police action. The SCBA also stated that members of the legal fraternity, including some of its own members who were present during the demonstrations, were reportedly injured.

The Association observed that any excessive use of force against peaceful protesters raises serious concerns in a democratic society governed by constitutional principles.

While expressing solidarity with those who were reportedly injured, the SCBA urged the competent authorities to conduct an immediate, impartial and time-bound inquiry into the incident.

The Bar body further stated that if any officials are found responsible for using force beyond what was legally permissible, appropriate action should be taken in accordance with the law.

Medical Assistance Also Requested

Apart from demanding an independent investigation, the SCBA appealed to authorities to ensure that all injured students and members of the legal community receive appropriate medical care and assistance.

The Association also stressed the importance of preventing similar incidents in the future through better crowd management practices and adherence to constitutional safeguards.

Reaffirming its commitment to constitutional governance, the SCBA stated that protecting human dignity, the rule of law and fundamental rights remains central to India's democratic framework.

SCAORA Raises Constitutional Concerns

In a separate statement, the Supreme Court Advocates-on-Record Association also voiced concern over reports and visuals relating to the police action.

According to the Association, peaceful demonstrations constitute an exercise of the freedoms guaranteed under Articles 19(1)(a) and 19(1)(b) of the Constitution of India, which protect freedom of speech and expression as well as the right to assemble peacefully.

The Association acknowledged that the State possesses the authority to maintain public order. However, it emphasised that any restriction imposed on constitutional freedoms must satisfy the principles of legality, necessity and proportionality.

SCAORA observed that democratic institutions must carefully balance public safety with citizens' constitutional liberties.

References to Supreme Court Judgments

The Advocates-on-Record Association referred to earlier Supreme Court decisions dealing with the right to peaceful assembly and police powers during public demonstrations.

According to the Association, judicial precedents have consistently recognised that while law enforcement agencies are empowered to regulate assemblies for maintaining public order, any use of force must remain proportionate to the circumstances and consistent with constitutional protections.

The statement underlined that allegations of excessive force should always be examined independently and objectively to maintain public confidence in legal institutions.

Call for Independent Probe

SCAORA also appealed for an impartial investigation into the events surrounding the protest.

The Association said that an independent inquiry would help establish the factual circumstances of the incident and determine whether the response of the authorities complied with constitutional and legal standards.

In addition, the Association urged authorities to provide immediate medical treatment to injured protesters and members of the legal fraternity wherever required.

It further encouraged future engagement between law enforcement agencies and peaceful demonstrators to be guided by dialogue, restraint and respect for constitutional values.

Background of the Protest

The demonstration was organised by student groups and supporters of the Cockroach Janta Party (CJP) amid growing public concern over alleged irregularities in competitive examinations, particularly the recent NEET-UG controversy.

Among the principal demands raised by the protesters were calls for accountability over examination-related issues and the resignation of Union Education Minister Dharmendra Pradhan.

Thousands of students reportedly gathered in New Delhi and attempted to march towards Parliament during the Monsoon Session. Police intervened to stop the procession, following which clashes reportedly occurred.

Visuals circulated on various media platforms appeared to show police personnel using batons and tear gas while dispersing sections of the crowd. Several protesters alleged injuries, while authorities have maintained that action was taken in accordance with law to maintain security and public order.

Legal Developments Continue

The issue has also reached the judiciary through multiple legal proceedings.

Earlier on Wednesday, the Delhi High Court heard a Public Interest Litigation seeking directions regarding the alleged use of force during the protests and related incidents involving activist Sonam Wangchuk.

The High Court declined to entertain the PIL, observing that certain issues had already been addressed in earlier proceedings while clarifying that individuals remain free to pursue remedies available under existing criminal and procedural laws.

The Court also noted that complaints regarding any alleged cognizable offences can be pursued through the legal mechanisms provided under the Bharatiya Nagarik Suraksha Sanhita (BNSS).

Debate Over Constitutional Rights

The latest statements by India's two prominent Supreme Court Bar bodies have added another dimension to the ongoing debate surrounding the protests.

Legal experts have frequently pointed out that the Constitution guarantees citizens the right to peaceful assembly and expression while also recognising the responsibility of authorities to maintain public order.

Whether the police response in the recent protests remained proportionate is likely to remain a subject of legal and public scrutiny as different proceedings continue before courts and other competent authorities.

At present, the statements issued by the SCBA and SCAORA represent calls for an independent examination of the allegations rather than findings of wrongdoing. No judicial authority has, so far, reached any final conclusion regarding the allegations made by either the protesters or the police.
