Lamp-Lighting Dispute at Thiruparankundram Hill Reaches Supreme Court

Tamil Nadu authorities have moved the Supreme Court challenging the Madras High Court’s recent orders permitting devotees of the Arulmigu Subramania Swamy Temple to light the Karthigai Deepam lamp on the Deepathoon, a stone lamp pillar located on the lower peak of Thiruparankundram hill. The appeal has been filed by the District Collector and the Commissioner of Police, Madurai.

The case was mentioned before a Bench led by Chief Justice of India Surya Kant and Justice Joymalya Bagchi on Thursday morning. During the brief interaction, counsel representing the devotees opposed the State’s request for urgent listing, while the State’s lawyer maintained that the authorities were only seeking a listing of the matter.

The hill includes both the Arulmigu Subramania Swamy Temple and the Sikkandar Badhusha Dargah. Devotees had approached the Madurai Bench earlier, seeking directions to ensure the traditional lamp-lighting ceremony could take place at the Deepathoon. On December 1, a single judge held that the temple had the right to light the lamp at the Deepathoon and noted that the dargah management’s historical rights extended only to limited areas of the hill.

The single judge observed that lighting the lamp at the Deepathoon would not affect the rights of the nearby dargah and directed district authorities to prevent any obstruction. After finding that these directions were not implemented, the judge passed another order on December 3 allowing devotees themselves to light the lamp and directed that they be provided protection by the Central Industrial Security Force attached to the High Court.

This order was challenged before a Division Bench of the Madras High Court, which dismissed the appeal on Wednesday, noting no irregularity in granting CISF protection when earlier directions were not followed.

The State has now approached the Supreme Court seeking relief from these orders. Meanwhile, a contempt petition filed by temple devotees regarding non-compliance with the initial order remains pending before the High Court.
