    No Extension from Supreme Court as Waqf Registration Deadline Approaches; Applicants Directed to Move Tribunal

    The Supreme Court on Monday refused to extend the six-month deadline for registering Waqf properties under the Waqf (Amendment) Act, 2025, and advised applicants to seek relief directly from the Waqf Tribunal before the 6 December cut-off.

    A Bench of Justices Dipankar Datta and Augustine George Masih made it clear that the registration process and any related disputes must be handled through the mechanism established by Parliament.

    Why the Supreme Court Declined to Intervene

    The Court observed that the amended law already provides a dedicated forum for addressing concerns related to Waqf property registration.
    According to the Bench, when a statutory remedy exists, judicial intervention is limited.

    Citing the available route for redress, the Court noted, “Applicants may approach the Waqf Tribunal by December 6, which is the final date for registration.”

    What the Petitioners Told the Court

    Counsel for the applicants argued that several procedural difficulties were making timely registration challenging. These included:

    • Issues with digitisation of property details

    • Technical errors on the UMEED portal

    • Concerns that the Tribunal may not be able to process applications before the deadline

    The petitioners said these hurdles went beyond simply uploading documents and could cause genuine delays for property-holders.

    Court’s View on Portal-Related Issues

    While acknowledging that technical glitches can occur, the Supreme Court maintained that applicants must still follow the statutory path.

    The Bench added that if the portal fails or freezes, applicants will not be penalised for delays beyond their control. The Tribunal, it stated, can consider such cases and grant relief accordingly.

    Next Steps for Property-Holders

    With the deadline remaining unchanged, individuals seeking registration of Waqf properties must now:

    • File their applications with the Waqf Tribunal before 6 December

    • Keep records of any technical problems faced on the UMEED portal

    • Seek extensions or clarifications directly from the Tribunal, which holds authority under the revised law

     

    The decision reinforces that the Tribunal is the primary forum for all disputes or delays arising from the 2025 registration framework. The deadline stays in place unless later modified through legislative or administrative action.
