EC Tells Supreme Court Centre’s Citizenship Scrutiny Powers Are Limited

The Election Commission of India (ECI) has informed the Supreme Court that the Union government’s role in citizenship scrutiny is restricted, countering the arguments made by Opposition parties in the ongoing case related to the Special Intensive Revision (SIR) of electoral rolls.

In its submission, the Commission stated that the Centre’s authority is confined to examining situations where an Indian citizen may have voluntarily acquired foreign citizenship. The ECI referred to Section 9 of the Citizenship Act, 1955, which empowers the Union government to determine whether and how an individual obtained citizenship in another country.

The ECI defended the SIR exercise as a constitutionally valid process carried out to maintain accurate and updated electoral rolls. It also clarified that the SIR does not infringe upon the Centre’s responsibilities and is conducted within the legal framework governing elections.

The matter continues to be heard by the Supreme Court, with further arguments expected in the coming days.
