INDIA Bloc MPs Submit Impeachment Notice Against Madras High Court Judge

A group of MPs from the INDIA bloc on Tuesday submitted an impeachment notice against Madras High Court Judge Justice G.R. Swaminathan, gathering the signatures of 120 Members of Parliament.

The notice was handed over to Lok Sabha Speaker Om Birla by DMK leaders Kanimozhi and T.R. Baalu, along with Samajwadi Party chief Akhilesh Yadav and Congress leader Priyanka Gandhi Vadra.

The impeachment motion, dated December 9, 2025, was moved under Articles 217 and 124 of the Constitution. It alleged that the judge’s conduct raised doubts about judicial neutrality, accused him of extending undue favour to a senior advocate and certain lawyers, and claimed that some orders reflected political leaning, contrary to the secular foundations of the Constitution. Letters addressed to the President of India and the Chief Justice of India were attached to the notice.

The action follows a dispute linked to the Thiruparankundram Karthigai Deepam ritual. Justice Swaminathan recently permitted the lighting of the traditional lamp on the “Deepathoon” pillar by December 4, rejecting objections from both temple administrators and the adjoining dargah management. The ruling allowed a small group of devotees, escorted by security, to carry out the ritual and stated that it would not interfere with the rights of the Muslim community.

The Tamil Nadu government, however, chose not to implement the court’s directive, citing potential threats to law and order. This led to protests by pro-Hindu groups and clashes with police, intensifying political tensions around the judgment.

Reacting to the impeachment move, BJP leader K. Annamalai criticised the INDIA bloc, describing the initiative as an act of “anti-Hindu politics” and arguing that it attempted to apply political pressure while an appeal was pending before the Supreme Court. BJP spokesperson Narayan Tirupathy claimed the motion was intended to intimidate the judge and argued that the opposition lacked the numbers required for it to succeed.

Meanwhile, the Supreme Court has agreed to hear the Tamil Nadu government’s challenge to the High Court order allowing the Deepam ritual at the Arulmighu Subramaniya Swamy Temple.
