New US Visa Rule Sparks Panic Among Indian H-1B and H-4 Applicants

A new US State Department rule requiring all H-1B workers, applicants, and their H-4 dependents to keep their social media accounts public for visa vetting has triggered widespread panic among Indians. The rule, which takes effect on December 15, allows consular officers to review applicants’ posts on platforms such as X, Instagram, and LinkedIn during both fresh visa applications and renewals.

Indians—who make up over 70% of all H-1B holders and nearly 90% of H-4 EAD beneficiaries—are expressing deep concern, as even routine comments, political views, or mismatched resume details could now lead to heightened scrutiny. Immigration lawyers report that tech companies are advising employees to clean up their profiles and avoid posting political content. Meanwhile, US consulates in India have abruptly cancelled visa interviews, with many December slots pushed to March 2026, leaving workers, new hires, and families stranded.

The State Department said the rule strengthens national security by expanding online-presence checks already used for student and exchange visas. The US Embassy in India has also warned applicants not to arrive on previously scheduled interview dates if they have received rescheduling emails, stating they will be denied entry.
