    Supreme Court Withdraws Relief for Older BS-III Vehicles in Delhi-NCR Amid Pollution Crisis

    The Supreme Court on Wednesday lifted the protection earlier granted to end-of-life vehicles with BS-III and lower emission standards in Delhi-NCR, citing worsening air pollution in the region. The move allows authorities to resume action against older, highly polluting vehicles.

    The decision came after the Commission for Air Quality Management (CAQM) urged the court to review its August 12 order, which had temporarily shielded all end-of-life vehicles—10-year-old diesel and 15-year-old petrol vehicles—from coercive measures. CAQM argued that continued operation of older vehicles was significantly adding to Delhi’s pollution load.

    Accepting the recommendation, the court modified its earlier order, clarifying that protection will now apply only to BS-IV and newer vehicles. “No coercive steps shall be taken for BS-IV vehicles and above,” Chief Justice Surya Kant said while pronouncing the order.

    The court’s August relief had effectively put on hold its 2018 ruling that upheld a 2014 National Green Tribunal (NGT) judgment banning older, high-emission vehicles from Delhi roads. That temporary relief led to thousands of end-of-life vehicles returning to the streets, prompting CAQM to reassess their environmental impact compared to BS-VI-compliant vehicles.

    CAQM highlighted that BS-III and older vehicles emit substantially higher pollutants, worsening already critical air quality levels in the capital. Based on this assessment, it recommended withdrawing relief for such vehicles in the interest of public health.

     

    With the latest ruling, enforcement agencies are once again empowered to take action against older, polluting vehicles as part of efforts to curb Delhi-NCR’s persistent air pollution problem.
