    Kerala Governor Questions Court’s Role in University Vice-Chancellor Appointments

    Kerala Governor Rajendra Vishwanath Arlekar on Sunday raised concerns over what he described as judicial overreach in matters related to the appointment of Vice-Chancellors in State universities. Referring to recent interventions in the selection process at Digital University Kerala and APJ Abdul Kalam Technological University, the Governor cautioned against institutions crossing their constitutional boundaries.

    Speaking in Thiruvananthapuram, Mr. Arlekar said that in a democratic framework, each institution has a clearly defined role and responsibility. He expressed concern over situations where one pillar of democracy assumes functions meant for another, warning that such trends could disturb the balance envisioned by the Constitution.

    The Governor emphasised that the authority to amend the Constitution lies with Parliament and elected legislatures, while the judiciary’s mandate is to interpret constitutional provisions. According to him, any departure from this separation of powers could set an unhealthy precedent.

     

    His remarks come amid ongoing debates in Kerala over university governance and the respective roles of the Governor, State government and judiciary in higher education administration.
